As part of AMAPCEO’s ongoing fight to protect flexible work and advocate for a modern, innovative workplace, the union filed an additional Unfair Labour Practice (ULP) complaint with the Ontario Labour Relations Board on March 30, 2026. The complaint challenges both the Ontario Public Service (OPS) Employer’s ongoing delays in responding to remote work requests and their restrictions on union expression in the workplace. AMAPCEO initially filed a ULP complaint and disputes at the Grievance Settlement Board in the late summer and fall of 2025 in response to the government and Treasury Board’s return to office mandate.
AMAPCEO members have submitted approximately 6,000 alternative work arrangement (AWA) requests, many of them dating back to August 2025. Only a small number have been answered. At the same time, members are being required to comply with the five-day in-office directive, which effectively prevents their access to remote work and the ability to dispute denials of requests.
The OPS Employer has also prohibited members from displaying union messaging or materials related to the Remote Works Works! campaign, both virtually (Teams backgrounds and profile photos) and physically (flags, posters, buttons). The Employer has threatened discipline for non-compliance with these restrictions of union materials in the workplace, while allowing other non-union workplace campaigns.
In the most recent Unfair Labour Practice complaint, AMAPCEO argues that these actions interfere with the union’s—and its members’—rights under the Labour Relations Act and violate freedom of expression rights under the Canadian Charter of Rights and Freedoms.
AMAPCEO is seeking several clear remedies from the OLRB, including an order requiring the Employer to immediately end its prohibition against union-related messaging, and an order requiring the Employer to respond to all outstanding AWA requests within 60 days.
