What is the Bill 124 remedy?

In January 2024, AMAPCEO secured an arbitrated remedy for members in the Ontario Public Service (OPS) who were affected by the government’s unconstitutional Bill 124. Individual salaries and salary ranges for OPS members will increase by:

April 1, 2022: 2%

April 1, 2023: 2.5%

April 1, 2024: 2%

This is in addition to the across-the-board wage increases that the union negotiated as part of the 2022–2025 AMAPCEO-OPS Collective Agreement:

April 1, 2022: 1%

April 1, 2023: 1%

April 1, 2024: 1%

The arbitrator also awarded special compensation adjustments to AMAPCEO members working in the following nursing positions:
- Clinical Nurse Advisor;
- Nurse Case Manager;
- Senior Nurse Consultant; and
- Nurse Advisor.
Who will receive the Bill 124 remedy?

Everyone who worked in an AMAPCEO-represented position in the Ontario Public Service between April 1, 2022 and today.

This remedy does not apply to any other bargaining unit.
What if I am no longer in an AMAPCEO-represented position?
- If your time working in an AMAPCEO-represented position in the OPS ended between April 1, 2022 and April 1, 2024 due to retirement, leaving the OPS, or was limited because you were on a secondment, you are entitled to the remedy for the period you spent working in the AMAPCEO-represented position.
I've retired; how will this impact my pension?

If you retired between April 1, 2022 and April 1, 2024, there may be an impact on your pension amounts once your final annual salaries have been recalculated.

The OPS Employer will provide new information to the Ontario Pension Board as soon as possible.
When will I receive the Bill 124 remedy?

The OPS Employer has advised that they are targetting to implement:

our negotiated 1% across-the-board (ATB) wage increases effective April 1, 2024 between mid-July and mid-August 2024, and
-
the backpay for our arbitrated Bill 124 remedy in November 2024.

AMAPCEO takes the view that this timeline is unacceptable. The OPS Employer has had 18 months of lead time to prepare for the implementation of our negotiated ATBs, and we shouldn't face the consequences of their poor planning and chronic understaffing. Nor should members have to wait until November 2024 to receive our arbitrated remedy for Bill 124.

AMAPCEO is calling on the OPS Employer to:

Immediately process the 1% across-the-board wage increases effective April 1, 2024.

Process the Bill 124 backpay on a reasonable timeline by investing in necessary staffing.

AMAPCEO is taking legal action. We are filing an Association Dispute against the OPS Employer over the delay in the negotiated wage increases.

How will I receive the Bill 124 remedy?

If you’re still working for the OPS, you will receive the retroactive remedy pay as an add-on to your regular paycheque.

Your pay stub will include the breakdown of the payment.

If you are no longer in the OPS, but are eligible for the remedy, the OPS Employer will contact you directly to arrange payment.
What if the payments are inaccurate?

If the adjustments you receive appear to be inaccurate (too little or too much), immediately contact your OPS Human Resources payroll representative.

If you need assistance locating or contacting that person, your manager should be able to assist you.

If you are unable to resolve payroll issues related to the remedy, contact an AMAPCEO Workplace Advisor for assistance.

If you accidentally receive more than you are supposed to, the OPS Employer will request the overage be returned.
